1 General provisions and acceptance of the Terms
These Terms of Use (the “Terms”) govern access to the Wizy website, mobile app and related services (together, the “Platform”), and the use of features for finding, publishing and undertaking shared rides.
By creating an account, clicking the registration confirmation button, publishing a Ride, submitting a Booking Request or otherwise using the Platform, you confirm that you have read and understood these Terms and agree to comply with them. Such action constitutes acceptance of an electronic offer to enter into a contract on the terms of this document.
If you do not agree to the Terms, do not create an account and stop using the Platform. Individual features may have additional rules shown to the User before use; in the event of a conflict, those specific rules take precedence only for the relevant feature.
2 Definitions
Wizy / we — the Platform provider whose details are given at the beginning of these Terms.
User — an adult individual who visits the Platform or has a Wizy account.
Driver — a User who publishes a Ride and drives the vehicle or lawfully arranges it on behalf of an appropriate transport operator.
Passenger — a User who searches for a Ride, submits a Request or has a Confirmed Booking.
Ride — a journey whose route, date, time, pickup and drop-off points, number of seats, price and other conditions the Driver has published on the Platform.
Booking Request — a Passenger’s request for one or more seats, awaiting the Driver’s decision where automatic confirmation does not apply.
Confirmed Booking — a booking confirmed by the Driver or automatically in accordance with the Ride settings.
Content — texts, photographs, voice messages, reviews, route and vehicle information, and other materials that a User posts or transmits through the Platform.
3 Wizy’s role
Wizy is a digital platform for finding travel companions and coordinating shared rides. Unless expressly stated otherwise for a particular service, Wizy is not a party to the arrangement between the Driver and Passenger, does not provide transport, and is not a taxi service, transport operator, tour operator, payment institution, insurer or agent of any User.
Users independently agree on the actual performance of a Ride and are responsible for their actions, documents, vehicle condition, compliance with the law and payments between them. Wizy provides digital tools but does not guarantee that a particular Ride will take place or meet a User’s subjective expectations.
Wizy may verify certain information, moderate Content, restrict access and apply safety measures, but such verification does not replace Users’ own care and is not a guarantee of another User’s identity, professional qualifications or reliability.
4 Account
- Only people aged 18 or over who have the necessary legal capacity may create an account and use the Platform independently.
- During registration, accurate and up-to-date information must be provided, including first name, last name, age, gender, phone number, email address and other mandatory details, and the required contact verification must be completed.
- A User must not create multiple accounts, transfer their profile to another person or register on another person’s behalf without proper authority.
- The User is responsible for keeping their password confidential, access to their device and all actions in their profile. Suspected unauthorised access must be reported to Wizy immediately.
- Public profile elements may include name, photo, age, role, rating, reviews, ride preferences and some vehicle information. The visibility of other data is determined by the Wizy Privacy Policy.
Users may correct profile data and request account deletion in the app or at info@wizy.net.ua. Deletion does not stop the processing of data that we must or are entitled to retain for the period specified by law or the Privacy Policy.
5 Platform features
Depending on its version, the Platform may offer, among other things:
- creating a Driver and/or Passenger profile, adding a vehicle and ride preferences;
- searching for Rides by departure point, destination, date, time, number of Passengers and available filters;
- publishing Rides and selecting the route, pickup and drop-off points, number of seats, price and confirmation method;
- submitting Booking Requests, automatic or manual confirmation, and cancellation;
- exchanging text messages, voice messages and images, system notifications and indicators of new events;
- viewing active and archived Rides, ratings and reviews, and contacting support.
The available features may differ depending on the device, operating system, region, User role and the Platform’s stage of development.
6 Publishing a Ride as a Driver
6.1 Driver and vehicle requirements
By publishing a Ride, the Driver confirms that:
- they hold a valid driving licence for the relevant category, have lawful grounds to use the vehicle, and have valid registration documents and compulsory insurance;
- the vehicle is roadworthy, suitable for the route and has enough passenger seats equipped with seat belts;
- information about the make, model, colour, registration plate number, comfort and in-car rules is truthful and up to date;
- the Driver is able to drive safely and is not under the influence of alcohol, narcotic substances or medication that prohibits driving;
- the Ride and its conditions comply with the laws of the countries through which the route passes.
6.2 Ride information
The Driver must accurately specify the departure point and time, destination, route, available seats, price per Passenger, rules on luggage, pets, smoking, music or conversation, limits on the number of Passengers in the back seat and other essential conditions. If information changes, the Driver must update the Ride in advance and notify interested Passengers.
The interface may allow a maximum of 10 Passengers to be specified. This is a technical upper limit, not permission to carry more people than the vehicle’s design and registration documents or the law allow. The actual number of Passengers is always limited to the lowest of these limits.
6.3 Sharing costs and professional transport
For a private shared Ride, the Driver sets a contribution that should reasonably cover part of the actual travel costs rather than generate systematic profit. The Driver must not use Wizy’s private ride format as an unlicensed taxi or commercial transport service.
If a User provides professional or business transport, they may do so through Wizy only when the relevant feature is expressly available and they independently hold all necessary registrations, licences, permits, insurance, tax status and documents. Wizy may request evidence and restrict the profile until verification is complete.
6.4 Automatic and manual confirmation
The Driver may choose automatic or manual confirmation where available. With automatic confirmation, a Request that meets the set parameters may immediately become a Confirmed Booking. If a Passenger joins at an intermediate point along the route, Wizy may require a separate manual decision from the Driver even when automatic confirmation is enabled.
The Driver must review Requests promptly. The number of new Requests may be shown by an indicator on the Platform. When rejecting a Request or cancelling a confirmed booking, the Driver must act in good faith; Wizy notifies the Passenger through available channels.
6.5 “Women only” option
The “Women only” safety option may be available only to female Users who have specified their gender as female, and applies to Rides in which both the Driver and Passengers are women. Falsely changing profile data to access this option or using it for discriminatory or misleading purposes is prohibited.
7 Searching and booking as a Passenger
The Passenger selects a Ride based on the available information about the route, time, Driver, vehicle, price, number of seats, in-car conditions, confirmation procedure and reviews. Before submitting a Request, the Passenger must check the essential conditions.
If the Passenger boards at an intermediate point, the Platform may display the actual starting point of the Driver’s route with a separate neutral marker, along with the Passenger’s pickup point and the final destination. This display helps explain the full route and does not mean that the Passenger is entitled to board before the agreed point.
Submitting a Request does not guarantee a seat until the Platform displays a Confirmed Booking. With automatic confirmation, a booking may be confirmed immediately. With manual confirmation, the Passenger must wait for the Driver’s decision and check notifications and status in the app.
The Passenger may contact the Driver through chat before booking, where the feature is available. Phone numbers and other direct contact details are disclosed only after a Confirmed Booking, except where the law or a safety situation requires otherwise.
8 Booking multiple seats and travelling with children
The Passenger must specify the actual number of people. The total amount in the interface is calculated as the price per Passenger multiplied by the number of seats booked, unless expressly stated otherwise. The Passenger must not bring more people than have been confirmed.
An adult User may book a seat for a minor only if they personally accompany the minor, have the necessary authority and have agreed child restraint equipment, luggage and other needs with the Driver in advance. Wizy is not intended for the unaccompanied transport of minors.
9 Price and payments between Users
9.1 Setting the price
The Driver specifies the price per Passenger. For pickup or drop-off at an intermediate point, the Platform may suggest a proportional amount based on the relevant part of the route. The displayed distance, duration and recommended amount are estimates and may change due to the route, traffic, weather or other conditions.
9.2 Direct payment
At the current stage, Wizy does not accept payment for Rides, store payment cards, charge a service fee or guarantee payment. The Passenger pays the agreed amount directly to the Driver after the Ride is completed, using a method agreed between them.
The Driver must not demand advance payment through chat, external links, a transfer to a card or any other channel. The Passenger must not make an advance payment to an unfamiliar person. Such demands should be reported to Wizy support.
If Wizy introduces its own payments, fees or refunds in the future, the User will be shown separate terms, payment amounts and payment rules before using the relevant feature.
10 Cancellations, changes and no-shows
10.1 Cancellation by the Driver
The Driver must cancel the Ride on the Platform as soon as they know it will not take place and, where possible, explain the reason. Wizy sends Passengers a system notification and moves the record to the relevant archive. Frequent, late or bad-faith cancellations may affect the reliability score and access to the Platform.
10.2 Cancellation by the Passenger
The Passenger must cancel a Request or booking as early as possible if they cannot travel. This releases seats for others and allows the Driver to adjust the route. Repeated no-shows without notice may result in restrictions.
10.3 Changes to conditions
Material changes to the time, route, pickup location, vehicle, price or number of seats require advance notice. The Passenger may decline the changed conditions without sanctions from Wizy. Since payment is made directly after the Ride, Wizy generally does not issue refunds.
11 General rules of conduct
Users are prohibited from:
- publishing false, outdated or misleading information, impersonating another person or forging documents;
- violating the law, the rights of others, traffic rules, or border, customs, immigration or sanitary requirements;
- threatening, stalking, humiliating, discriminating against, sexually harassing or using violence against others;
- transporting prohibited items, weapons without lawful grounds, dangerous substances or property that creates a risk;
- sending spam or fraudulent messages, demanding advance payment, collecting other people’s data or moving communication outside Wizy to bypass safety measures;
- interfering with the Platform, bypassing technical restrictions, using bots, malicious code, reverse engineering or automated data collection without written permission;
- making fictitious bookings, manipulating ratings, reviewing a Ride in which the person did not participate or coordinating false reviews;
- using Users’ contact or other personal data for purposes other than arranging the specific Ride.
12 Driver’s obligations during a Ride
- arrive at the agreed location on time or give advance notice of a delay;
- check that the number of people and luggage match the confirmation and the vehicle’s safe capacity;
- comply with traffic rules and work and rest requirements, choose a safe speed and not use a phone while driving without permitted equipment;
- not change the Driver or vehicle without advance notice and the Passenger’s consent where the change is material;
- respect the agreed conditions on smoking, pets, music, conversation, luggage and the number of Passengers in the back seat;
- in the event of an accident or danger, first contact the emergency services and then notify Wizy when safe to do so.
13 Passenger’s obligations during a Ride
- arrive on time at the agreed pickup point and remain available through confirmed communication channels;
- disclose luggage, pets, child seat requirements, reduced mobility or other essential needs before confirmation;
- wear a seat belt, not distract the Driver and comply with lawful safety-related instructions;
- not bring prohibited or dangerous items and not be in a condition that creates a risk to others;
- pay the Driver the agreed amount after the Ride, unless the parties have agreed on a free Ride;
- treat the vehicle with care and compensate for proven damage caused through the Passenger’s fault, in accordance with the procedure provided by law.
14 Chats, contact details and fraud prevention
Chat is intended for questions about a Ride and its coordination. Users may exchange text, images and voice messages where the relevant features are available. New messages may be indicated by menu indicators.
Do not send passwords, verification codes, payment details, copies of documents or other data unnecessary for the Ride through chat. Wizy may use automated and manual tools to detect spam, fraud, threats and violations, and may retain and review messages in the circumstances described in the Privacy Policy.
A phone number disclosed after confirmation may be used only to arrange the relevant Ride and for safety. Using it for advertising, harassment or sharing it with third parties is prohibited.
15 Content, photos, reviews and licence
The User retains the rights to their Content and is responsible for the lawfulness of posting it. By posting Content, the User grants Wizy a non-exclusive, royalty-free licence, valid for the period during which the Content is posted and a reasonable technical period after deletion, to store, reproduce, technically transform and display the Content to the extent needed for the operation, security, support and improvement of the Platform.
A review must concern a real interaction, be honest and not contain insults, discrimination, threats, advertising, other people’s personal data or knowingly false statements. Wizy may hide or delete Content if it violates these Terms, the law or the rights of others.
A complaint about Content may be submitted to info@wizy.net.ua with a link or a description of its location, the grounds for the complaint and, where possible, evidence. We may request additional information and communicate the outcome within a reasonable time.
16 Safety and international Rides
Before a Ride, check the profile, rating, vehicle details, route and contact information; share the details with someone close to you; do not agree to advance payment; and decline to board if the vehicle, Driver or conditions do not match. In immediate danger, contact the emergency services. Wizy does not replace the police, medical assistance or an insurance company.
For an international Ride, each User is independently responsible for their passport, visa, right to cross the border, and documents for children, pets, luggage and goods; the Driver is also responsible for vehicle documents, international insurance and permits. Wizy does not guarantee border crossing times or the ability to enter a country.
17 Moderation, restrictions and account deletion
To protect Users and the Platform, Wizy may issue a warning, hide Content or a Ride, restrict individual features, or suspend or close an account. Grounds may include a violation of the Terms or the law, a safety risk, fraud, numerous substantiated complaints, a requirement of a competent authority or the need to protect the rights of others.
Where this does not create a risk and is not prohibited by law, we will explain the reason and provide an opportunity to respond. The User may appeal the decision through info@wizy.net.ua. In urgent cases, restrictions may be applied without prior notice.
Users may delete their profile in the settings or contact support. Active Rides and Requests should be cancelled before deletion. Closing a profile does not cancel rights and obligations that arose earlier or require deletion of data lawfully retained for disputes, security, record-keeping or compliance with the law.
18 Wizy’s intellectual property rights
The Platform, its software code, design, databases, texts, graphics, logos, domain names and other Wizy materials are protected by law and belong to Wizy or are used on a lawful basis.
Wizy grants the User a limited, non-exclusive, revocable and non-transferable right to use the Platform for personal, lawful purposes in accordance with these Terms. Copying, selling, licensing, publicly distributing or creating derivative products based on the Platform without written permission is prohibited, except where expressly permitted by law.
Ideas and suggestions for improvements may be submitted voluntarily; Wizy may use them without an obligation to pay compensation unless the parties agree otherwise in writing.
19 Third-party services and availability
The Platform may use maps, geocoding, notifications, cloud infrastructure, app stores and other third-party services. The providers’ own terms and policies may apply to those services. Wizy does not control their uninterrupted operation.
Routes, distances, arrival times, addresses and intermediate settlements generated by mapping services are estimates. The Driver must choose a lawful and safe route, and Users must verify the actual pickup location.
We aim to keep the Platform available but may temporarily restrict it due to maintenance, updates, security incidents, communication disruptions, providers’ actions or circumstances beyond our control.
20 Liability
Each User is responsible for their own actions, arrangements, Content, documents, legal compliance and damage caused through their fault. Disputes about the actual performance of a Ride, direct payment, luggage, behaviour or damage to a vehicle should first be resolved between the parties; Wizy may facilitate communication but is not obliged to decide matters in place of a court or competent authority.
To the extent permitted by law, Wizy is not liable for the Driver’s or Passenger’s acts or omissions, road accidents, vehicle condition, loss of property, route changes, missed connections, refusal of entry at a border, inaccuracies in third-party maps or interruptions to third-party services.
Nothing in these Terms limits liability that cannot be excluded by law or deprives consumers of mandatory rights. If Wizy fails to fulfil its own obligation to provide a digital service, liability is determined by applicable law, taking into account the nature of the breach, causation and proven losses.
21 Force majeure
A party is not liable for failure to perform obligations caused by extraordinary and unavoidable circumstances beyond its reasonable control, including military operations, air raid alerts, movement restrictions, natural disasters, widespread communications or power outages, decisions of public authorities or border closures. The party must take reasonable steps to mitigate the consequences and notify others when possible.
22 Changes to the Terms
Wizy may update the Terms due to changes in features, legislation, security requirements or the business model. The current version is published on the Platform with its effective date. We will notify Users of significant changes through the app, email or another available channel in advance, usually at least 15 calendar days beforehand, unless the law requires otherwise or an urgent change is needed for security or legal compliance.
Continued use after the changes take effect constitutes acceptance of the updated Terms unless another method of consent is required by law. If the User disagrees, they must stop using the Platform and may delete their account.
23 Privacy
Personal data is processed in accordance with the document “Wizy — Privacy Policy”, which explains data categories, purposes, legal bases, recipients, retention periods, User rights and the rules on location, chats, technical identifiers and profile deletion.
24 Applicable law and dispute resolution
These Terms are governed by Ukrainian law unless mandatory provisions of the consumer’s country of residence require otherwise. First send a request to info@wizy.net.ua describing the situation, date, route, Ride identifier and any available evidence. We aim to provide a substantive response within a reasonable time.
If no agreement is reached, the dispute may be referred to a competent court or other authority in accordance with the law. Users may also contact consumer protection authorities, the Ukrainian Parliament Commissioner for Human Rights regarding personal data, or other competent authorities.
